Terms Of Service Non-Commercial

1. Seller/Artist/Copyright Protection

I, Moriah Sweitzer (Myra Sylus), claim the rights to the produced drawing, not the buyer. Therefore I am allowed to use the Copyrighted artwork to:
  • Record the drawing process and am allowed to post it anywhere I want to. Though it will be primarily Youtube.
  • Promote myself with your commissioned art but I will not claim the character as mine.
  • Display the finished art piece anywhere I want.
  • All art may or will include a subtle sign that you are not allowed to remove from the art piece and if you are found out about it we are viable to take down the image.

2. Buyer Protection

  • You are allowed to use the commissioned piece for personal use unless agreed otherwise (you can upload it on all your social media profiles, forums, etc.)
  • You may print the artwork (for yourself) and claim the character(s) as their own, but not the artwork itself
  • You may use the artwork to promote yourself without any forms of monetary profit
  • You may use the artwork in monetized places as long as the artwork itself is not the subject of the earnings

3. Revisions

  • You are allowed 3 changes to the base commissioned piece that is included in the price, and any additional changes in that will have an extra fee - unless there is a misunderstanding from the Seller/Artist side
  • If you want something changed in the commission that you have previously approved there will be a fee charged in association of the change; This has more power over the first bullet under the “Revisions” TOS
  • If your references are unclear or not enough information is given and I have to infer some parts on a commission then any changes will also have a fee; This has more power over the first bullet under the “Revisions” TOS
  • This is charged at an extra percentage that is based off an hourly wage that is used to change the part in the commission

4. Copyright/Usage Policy

The following is considered copyright infringement:
  • Reproducing/Using the copyrighted artwork commercially - means making money off it in any way.
  • Claiming the artwork as your own
  • Removing my signature from the artwork
  • Altering the artwork with malicious intent (you may also ask me about making changes if you want to make changes to the artwork)
  • I reserve the full rights to the image and its use/distribution unless otherwise agreed upon (rights to the image for your own non-personal use may be purchased at any time)

5. Customer Satisfaction

I want to do everything in my power to make the customers happy! If you ever have problems with anything in the commissioned piece then please tell me right away so we can find a solution together. I am willing to change previously defined restrictions and terms (but can with their respective fees) before I start on the commission. If you also do not want me to post my art anywhere or want to change the art to a commercial license then contact me and we can change that (again these can come with their respective fees)

Terms Of Service Commercial

  • Displaying the art piece on my social media
  • Using it to promote my ability in art but NOT to take ownership.
I will only include a small signature in the bottom of the image as an accreditation to me but will not obstruct anything about the image. If for some reason this is not okay then you need to bring it up with me when giving me the information and we can discuss it.

2. Buyer Protection

  • You are allowed to use the commissioned piece for commercial uses anywhere that the non-commercial would prohibit while also including the places non-commercial can be used.

  • You may use the artwork to promote yourself with any forms of monetary profit and non-monetary profit.
